In these terms, The Tailors Lounge ABN 46 690 443 184 is referred to as “we”, “us” or “our”. When we refer to “you” or “your”, we mean the person using this Website or purchasing products from it.

These terms apply when you use our website at www.thetailorslounge.com.au and any related pages we operate on that domain (Website).

These terms also apply when you purchase products through our Website (Products).

Our Privacy Policy also applies to your use of the Website and to any personal information you provide to us. You can view it on our Website.

Please read these terms carefully before using the Website or placing an order. By using the Website or placing an order, you agree to be bound by these terms.

We may update these terms from time to time by publishing an updated version on the Website. The version in force at the time you place your order will apply to that order.

Part A — When you buy Products

2. Placing an order

By submitting an order through the Website (Order), you confirm that:

  • you have the legal capacity to enter into a binding agreement with us; and
  • you are authorised to use the payment method provided with your Order.

Submitting an Order is an offer by you to purchase the Products in accordance with these terms.

A contract is only formed once we accept your Order and send you confirmation that it is being processed. We reserve the right to accept or reject any Order.

3. Accounts

You may place an Order as a guest or through an account, if account functionality is available on the Website.

If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

You agree to provide accurate, current and complete information and to keep that information up to date.

We may suspend or cancel an account if we reasonably believe these terms have been breached or the account is being misused.

4. Products

4.1 Product descriptions

We aim to ensure that Products are described as accurately as possible on the Website. However, colours, textures and finishes may vary slightly due to screen settings, photography and display differences.

Images are for illustration purposes only and may not perfectly reflect the final appearance of a Product.

4.2 Sizing

Where sizing information is provided, you are responsible for reviewing the relevant size guide before purchasing.

If a Product includes a size chart or fit guide, you should check it carefully before placing your Order.

4.3 Materials and product information

We aim to accurately describe materials and product features on the Website. If you need further information about a Product before purchasing, please contact us.

If you have allergies or sensitivities to particular fabrics or materials, you should consider this before purchase and contact us if you require further information.

4.4 Title and risk

Title in the Products passes to you once full payment has been received by us.

Risk in the Products passes to you on delivery.

5. Gift cards, vouchers and discount codes

We may offer gift cards, promotional codes or vouchers from time to time.

Unless otherwise stated:

  • gift cards and vouchers are redeemable only through our Website or as otherwise specified by us;
  • they are not redeemable for cash;
  • they are not transferable, refundable or reloadable;
  • they cannot be applied retrospectively to completed Orders; and
  • additional conditions may apply to a particular promotion, voucher or gift card.

We reserve the right to cancel or refuse any voucher, promotion or discount code where we reasonably suspect misuse, fraud or breach of its terms.

6. Pricing and payment

All prices on the Website are in Australian Dollars (AUD).

Unless otherwise stated, prices shown on the Website include GST where applicable.

You must pay the full amount for your Order at the time of checkout unless we agree otherwise in writing.

We may use third-party payment providers, including Stripe, to process online payments. Your payment may also be subject to the terms and privacy practices of the relevant payment provider.

We reserve the right to correct pricing errors, product description errors or other obvious mistakes on the Website. If we discover an error affecting your Order, we may contact you to offer the option to proceed at the correct price or cancel the Order for a full refund.

7. Shipping and delivery

Delivery costs, if applicable, will be shown at checkout.

Unless otherwise stated on the Website, Orders are fulfilled for delivery within Australia only.

We do not currently offer international shipping through the Website.

Delivery timeframes are estimates only. We do not guarantee dispatch or delivery by a particular date.

We are not liable for delays caused by couriers, postal services, supply interruptions or other events beyond our reasonable control.

You must provide accurate delivery details. We are not responsible for loss or delay resulting from incorrect address information provided by you.

8. Changes and cancellations

8.1 Cancellation by us

We may cancel an Order before dispatch where reasonably necessary, including where:

  • a Product is unavailable;
  • there is a pricing or listing error;
  • we reasonably suspect fraud;
  • there is an issue processing payment; or
  • delivery is not reasonably possible.

If we cancel an Order after payment has been received, we will refund the amount paid to the original payment method.

8.2 Cancellation by you

You may request to cancel an Order before it has been processed or dispatched.

Once an Order has been processed or dispatched, we may not be able to cancel it. Any return after dispatch will be handled in accordance with our Returns section below and your rights under Australian Consumer Law.

9. Returns, exchanges and refunds

9.1 Change of mind

We may, at our discretion, offer a change-of-mind return, exchange or store credit for eligible Products.

To be eligible, the Product must usually be:

  • returned within the timeframe specified on our Website or otherwise advised by us;
  • unworn, unused and unwashed;
  • in original condition;
  • with original tags attached; and
  • accompanied by proof of purchase.

Unless required by law, change-of-mind returns:

  • do not include original shipping costs;
  • may require the customer to pay return shipping costs; and
  • may not be available for sale items, gift cards, personalised items, special-order items or any other items marked as non-returnable.

Nothing in this clause limits your rights under Australian Consumer Law.

9.2 Faulty, damaged or incorrect Products

If you receive a Product that is faulty, damaged, not of acceptable quality, not fit for purpose, or not as described, please contact us as soon as possible with details of the issue and, where possible, photographs.

Where required by law, we will provide a remedy in accordance with Australian Consumer Law. Depending on the nature of the issue, this may include repair, replacement, refund or another appropriate remedy.

We may ask you to return the Product for assessment where reasonably necessary.

9.3 Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth) or any other applicable law, including the consumer guarantees under Australian Consumer Law.

10. Intellectual property in Products

We retain all intellectual property rights in the Website, our branding, product content, copy, graphics, images, logos and other material created by or for us, unless otherwise stated.

You must not copy, reproduce, adapt, distribute, commercialise or exploit any part of our Products, branding, packaging or Website content without our prior written consent.

11. Third-party suppliers

We may engage third parties to supply, fulfil, package, process or deliver Products or to support the operation of our online store.

To the extent permitted by law, we are not liable for the acts or omissions of those third parties except where responsibility cannot lawfully be excluded.

You and we submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
